affiliates: terms & conditions

Welcome to the Chick Magnets NY ("Chick Magnets") Affiliate Program. By joining, you agree to the following terms and conditions. This agreement is intended to be fair, clear, and to protect both parties.

1. Eligibility

We welcome affiliates who share our love of outdoor card play! We reserve the right to accept or decline applicants at our discretion.

2. Promotional Guidelines

We ask that you represent our products and brand honestly and respectfully:

  • Do not engage in misleading or spammy promotion.
  • If you use affiliate links in emails, please ensure you comply with email marketing laws and obtain proper permissions.
  • Clearly and conspicuously disclose your affiliate relationship in any promotional content, in compliance with applicable laws and platform rules.
  • Do not promote our brand in connection with adult content, hate speech, or anything offensive, defamatory, or illegal.
  • Do not place paid ads using our name, brand, or domain in the ad copy or URL (e.g., Google Ads or sponsored Instagram posts directing to chickmagnets.co).
  • You are responsible for your own content and agree to hold Chick Magnets NY harmless for any claims related to it.

3. Commissions

As a member of the Chick Magnets affiliate team, you’ll earn a commission on referred orders through your unique link. You’ll be able to track your earnings through your affiliate dashboard.

Standard Rate Your commission rate is listed in your affiliate portal and is calculated on purchase subtotals (after discounts, before taxes and shipping).

Tracking We use cookies to track referrals for 7 days. If a customer places an order within that window, the most recent affiliate link they used will receive the credit.

Adjustments If an order is canceled, refunded, or returned, the associated commission will be deducted or withheld accordingly.

Affiliates are responsible for ensuring their referral links are correctly implemented- Chick Magnets is not liable for tracking failures due to improper use or technical issues outside of our control.

4. Payment

Threshold & Frequency Commissions are paid on fixed calendar quarters. Each payout includes commissions for sales made through the date 30 days prior to the end of the quarter to allow for returns or refunds. For example, the September 30 payout covers sales through August 30.

Method Payments will be made by PayPal (net of any PayPal fees) or check, as determined by Chick Magnets. If required by law, we’ll ask for a completed W-9 before issuing payment. 

5. Compliance & Termination

Compliance with Laws Affiliates are expected to comply with all applicable laws, including marketing and privacy regulations.

Termination Either of us may end this agreement at any time for any reason by giving written notice (email is fine). If we terminate due to a breach of these terms (e.g., inappropriate conduct or violations), any unpaid commissions may be forfeited. Otherwise, we’ll pay out any remaining approved commissions.

We may withhold unpaid commissions for a short period after termination to account for returns or adjustments.

6. Changes to This Agreement

We may update these terms (including commission rates) from time to time. We’ll notify you by email or within the affiliate portal. Continued participation after the effective date of a change constitutes your acceptance. If you don’t agree with an update, you may terminate your participation.

7. Legal Stuff

Independent Parties We’re independent businesses. This agreement doesn’t create a joint venture, agency, or employment relationship.

Limitation of Liability We are not liable for indirect damages or lost profits. Our total liability is limited to the total commissions earned by you under this agreement.

Disclaimers We don’t guarantee any specific income or outcomes from the program. We may modify, suspend, or discontinue the program at any time.

Governing Law This agreement follows the laws of New York. Any disputes will be handled in accordance with those laws.

Assignment & Binding Effect You can’t transfer this agreement without our written permission. This agreement is binding on both of us and our respective successors.

No Waiver If we don’t enforce part of this agreement, that doesn’t mean we waive our right to do so later.

Confidentiality Please treat any non-public information we share with you as confidential.

Sanctions Compliance By participating, you confirm that neither you nor your financial institution are subject to government sanctions.
